Supreme Court allows Biden to end Trump-era 'Remain in Mexico' policy

The policy required people seeking asylum at the southern border to wait in Mexico while their claims were decided.

WASHINGTON — The Supreme Court handed President Joe Biden a victory Thursday, ruling that he can shut down a Trump administration program designed to restrict immigration at the southern border.

The court said in a 5-4 ruling that the Biden administration acted properly in seeking to end the "Remain in Mexico" policy, formally known as the Migrant Protection Protocols. It required people seeking asylum at the southern border, mainly from Central America, to wait in Mexico while their claims were decided.

Writing for the majority, Chief Justice John Roberts said a lower court overreached when it found the policy had to remain in place.

Under "the court of appeals’ interpretation," he wrote, a judge could "force the executive to the bargaining table with Mexico, over a policy that both countries wish to terminate, and to supervise its continuing negotiations with Mexico to ensure that they are conducted 'in good faith.'”

Roberts was joined by Justices Brett Kavanaugh, Elena Kagan, Sonia Sotomayor and Stephen Breyer.

In a sharply worded dissent, Justice Samuel Alito criticized border policy and said it was his colleagues who erred.

"Due to the huge numbers of aliens who attempt to enter illegally from Mexico, DHS does not have the capacity to detain all inadmissible aliens encountered at the border, and no one suggests that DHS must do the impossible. But rather than avail itself of Congress’s clear statutory alternative to return inadmissible aliens to Mexico while they await proceedings in this country, DHS has concluded that it may forgo that option altogether and instead simply release into this country untold numbers of aliens who are very likely to be removed if they show up for their removal hearings. This practice violates the clear terms of the law, but the Court looks the other way," Alito wrote in a dissent that was joined by Justices Clarence Thomas and Neil Gorsuch. 

In a separate dissent, Justice Amy Coney Barrett said she thought the court shouldn't have decided the case on the merits because more information was needed.

Kavanaugh, in an opinion concurring with Roberts, noted the number of people sent back while the Trump administration was using the policy was "relatively small." "In general, when there is insufficient detention capacity, both the parole option and the return-to-Mexico option are legally permissible options under the immigration statutes. As the recent history illustrates, every President since the late 1990s has employed the parole option, and President Trump also employed the return-to-Mexico option for a relatively small group of noncitizens," Kavanaugh wrote.

The wages of Biden's open border: 46 found dead in a San Antonio truck

So how's Joe Biden's and Kamala Harris's open border going, where Homeland Security chief Alejandro Mayorkas has said he has "operational control"?

According to Fox News:

At least 46 undocumented migrants were found dead in a tractor-trailer in San Antonio, Texas and more than a dozen were hospitalized, authorities said. 

Crews were at the 9600 block of Quintana Road where an 18-wheeler containing up to 100 migrants inside was found abandoned, Fox San Antonio reported. The discovery is part of what is believed to be a human smuggling operation. 

"This is nothing short of a horrific human tragedy," San Antonio Mayor Ron Nirenberg said Monday night near the location where the tractor-trailer was found.

The temperature outside was reportedly 106 degrees Fahrenheit. Imagine what it was inside the truck. The space had to have been constrained. There was no water. There was no air conditioner nor cooling and it was a supposedly refrigerated truck. Some of the very few survivors were reportedly kids. 

Some beast left the truck on a San Antonio street and didn't even unlock the back doors so that at least the migrants being smuggled could get out. The only reason the box of horror was discovered at all was because a passerby heard cries from the inside for help.

All one can think is how terrible it was for these migrants who had been promised heaven by their cartel human-smuggling syndicates. Their cries for help had to have started well before they began dying. Imagine how it was when the first person started dying? Imagine being there when the 30th died in the heat, not even knowing where one was...it's just unthinkable, like the despair of the men on the slowly capsizing Edmund Fitzgerald asking "where the love of God goes..." Unthinkable.

It doesn't matter if they were illegal border crossers at this point, they were human beings and nobody deserves to die a cruel suffocating death like that -- as some kind of misplaced or forgotten cargo, with some human smuggler stepping away to save himself for unknown reasons, perhaps fear of arrest or not being paid or something else. The size of the death count is comparable to that of a cartel massacre of migrants who didn't pay the crossing fees that happened in the north of Mexico years ago, after a mass grave was discovered. 

Well, now the mass graves are happening here in the states, big ones, consistent with huge human smuggling syndicates and the cartel organized cash it takes to organize them. Freelance border coyotes taking a family at a time across the Rio Grande can't pull off these kinds of operations such as what was found in the truck, which had to have been an experienced operation. That means that someone out there enabled these illegal migrant organizations to get very, very big, both from extended "business," and from the cartel expectation that the truck would never be intercepted nor break down, or whatever it was that happened that led to the truck becoming an abandoned death chamber on a street in San Antonio. Cartels have reportedly been heard in TikTok videos bragging about all the money they were making from human smuggling.

Texas Gov. Greg Abbott and other Texas Republicans put the blame squarely where it belonged.

According to Fox News:

In a tweet, Abbott said Monday evening's discovery rests squarely on Biden. "At Least 42 People Found Dead Inside Truck Carrying Migrants In Texas. These deaths are on Biden," Abbott said, before officials raised the death count to at least 46.

The Republican governor also criticized Biden for not doing enough to secure the southern border.

"They are a result of his deadly open border policies. They show the deadly consequences of his refusal to enforce the law," Abbott added.

Several other officials blamed the incident on Biden’s immigration policies, including Texas Sen. Ted Cruz, who called the discovery "horrific" and "wrong." 

"How many more people have to die before Dems give a da--?" he asked, before making a reference to Biden’s border crisis.

Rep. Tony Gonzales, a Republican who represents Texas, also tweeted about the incident.

"Today in San Antonio it was 102 degrees. Imagine being abandoned inside an 18-wheeler left to die - 42 people died today - will @AliMayorkas even mention their names?" the lawmaker said, referencing Alejandro Mayorkas, who was nominated by Biden to lead the U.S. Secretary of Homeland Security.

"Death count rises to 46 with another 16 in the hospital, to include 4 kids. Lord when will the nightmare end," the Republican added in another tweet.

To date, neither Biden, nor Mayorkas, nor border czar Kamala Harris have said a thing about this mass death of migrants at the hands of human smuggling syndicates. 

Guilty consciences? Hopes the news cycle will move on to something more palatable? They claim operational control -- and it's pretty obvious they don't have anything like operational control.

There will undoubtedly be talk of getting to the bottom of it, but what's needed is action to ensure it can't happen. The border wall needs to go up. Cartel members and their allies should not be allowed to operate in this country. Human smuggling networks should be cracked down on. Illegal migrants, most of whom will take dangerous risks in the hands of cartels, must know that if they are caught in the states, they will be sent back, making the proposition of working with a cartel to get into America a far less attractive prospect.

Most of all, the border needs checks and controls from the U.S. and Mexican authorities, because abandoning it, as Mayorkas has done, has left it in the hands of cartels. This enhanced security will have to include, unfortunately, stricter inspections of international and cross-border transport trucks, which apparently have been pretty active on the human smuggling front, given this recent mass death incident.

A few weeks ago, Gov. Greg Abbott signed a deal with Mexico's border governors to enhance their border security in exchange for relaxed inspections of trucks. I saw a tweet yesterday by Bill Melugin which does not seem to be up there now, that the governor of Mexico's Tamaulipas state has not been keeping his end of the bargain and has actually helped actively escort migrants into the south Texas corridors. If the tweet was deleted, it may have been incorrect information, or inadvertantly classified information, or perhaps I am wrong about the source, but if it's true, then the deal should be off and the gloves should be off about what gets inspected at the border. It's an issue that requires further investigation as a potential reason for this surge in dangerous cartel human smuggling traffic into the states. 

This by the way, isn't the only industrial scale operation that is being detected -- Fox News's Melugin also found a case where a huge stash of fentanyl from a border operation was found in California around the same time -- and a leftist D.A. actually let the smugglers of that cartel operation out on their own recognizance. The border is indeed open.

In the meantime, where's Joe? Where's Mayorkas? Where's Kamala? This kind of mass death incident has happened once and you can bet it will happen again.

Somebody out there is making a lot of money smuggling illegal migrants into the states and now that they are trafficking in industrial scale volume, human life is getting very, very cheap.

Biden's Nominee to Lead ICE Withdraws from Consideration

On Monday night, Ed Gonzalez signaled that he was withdrawing himself from consideration as President Joe Biden's nominee to lead Immigration and Customs Enforcement (ICE). 

The Hill, in highlighting a series of tweets from Gonzalez announcing the decision, mentioned that the nominee has faced domestic violence allegations.

Gonzalez's tweets indicated he announced his decision to the president on Sunday, and that he had made the decision "after prayerfully considering what's best for our nation, my family, and the people of Harris County who elected me to serve a second term as Sheriff."

As a result of the allegations, which Gonzalez claimed were "false" and "all politics," Sen. James Lankford (R-OK) on March 7 wrote a letter to Senate Majority Leader Chuck Schumer (D-NY) and Sen. Gary Peters (D-MI), the chairman of the Homeland Security and Governmental Affairs Committee. In it, he called for a delay of a vote on Gonzalez that was supposed to take place that week. 

The next day, on March 8, Democrats withdrew the motion for a procedural vote on Gonzalez's nomination, which CNN noted at the time was "an unusual move."

Gonzales had first been nominated on April 28, 2021. He is one of multiple nominees to withdraw, as Neera Tanden also did in March of last year when she was being considered to head the Office of Management and Budget (OMB). David Chipman, who had been considered to the Bureau of Alcohol, Tobacco, and Firearms (ATF), was pulled from consideration by the White House last September.

The Controlled Demolition Of America

Historically, opposing political parties have fought hard against each other during elections before coming together in the end to unite the country around the winner. While differences on policy positions have always existed, the belief that one or the other party has evil intentions was largely unheard of. It was assumed that everyone loved their country - the Republic that was founded in 1776 - and truly wanted what is best for it and all its people, regardless of political differences. Sadly, those days are long gone.

Newton's third law states: “For every action, there is an equal and opposite reaction.” From crime to inflation to uncontrolled immigration to everything in between, the United States is falling apart. Nothing is going right. So much so that it’s hard not to imagine it isn’t purposeful, especially considering that key policy changes could at least begin to get things on the right track. But instead of embracing clear, simple solutions or simply reversing the current disastrous course, our overlords keep stubbornly clinging to the policies that are obviously leading to financial and societal ruin.

What is going on today in America is unprecedented in the more than two centuries of our history, a controlled demolition managed by hostile forces who clearly intend to replace our once-great country with a socialist/communist hellscape of their own making. Like it or not, it’s the only logical conclusion. They know, however, that in order to initiate the Great Reset they so desire and force the majority of people to at least tolerate it, they have to destroy the current order and bring the population to its knees begging for relief. And while they would never admit what they are doing, at least right now, their actions speak louder than any words they say possibly could.

Crime

From random people getting cold-cocked in the streets in broad daylight to gangs of masked thugs taking unlimited 5-finger discounts en masse at retail outlets, crime in American cities is unlike anything we’ve seen in decades. And yet, liberal district attorneys across the country still reward lawlessness with leniency, refusing to punish and prevent the very activity that will ultimately lead to those cities becoming empty shells of their former glory. It’s almost like they WANT this to happen.

Homelessness

You don’t have to walk far in any of America’s major cities to see that homelessness has become a huge issue. Sadly, the problem goes far beyond the stench and the visual blight of once-beautiful streets trashed with tents, grocery carts, and trash to robberies and violent crimes committed by mentally ill people who should never be free to roam those streets in the first place. And while it’s definitely a problem in most major cities, it’s exponentially worse in places run by left-wing Democrats like San Francisco, Los Angeles, and even Austin, Texas. Purposeful leftist policies exacerbate the problem instead of even coming close to solving it. Which has obviously been the plan all along. (Also, I plan on solving it in a column very soon, so stay tuned and you’re welcome!)

Inflation

Both parties claim to care about lower and middle class people, yet they consistently follow policies - like decades of uncontrolled spending - that intensify the cruelest tax possible that ONLY hurts those people - inflation. Yes, Democrats are worse than Republicans in this area, but not by a lot. Anyone with half a brain could have predicted what would happen when all these Covid bills were passed, yet they unapologetically did it anyway, time after time. That’s the very definition of intentional.

High Fuel Prices

Democrats bear nearly all the blame here, and it’s not even close. What did Biden & co. think would happen when they closed the Keystone XL pipeline, restricted drilling, and put a ridiculous embargo on Russian oil? These people may be evil, but they’re not stupid. They knew exactly what would happen, and they’re more than pleased with their ‘work.’

Supply Chain Disruptions

No, supply chain disruptions aren’t entirely the fault of any political party, even Democrats. However, they were foreseen and could have been addressed and alleviated by even a small portion of the bloated infrastructure bill they passed in 2021. Instead, everything became infrastructure except for, you know, actual infrastructure.

Uncontrolled Immmigration

There’s no doubt that uncontrolled immigration is a means to an end, regardless of how much they call us nasty names for discussing it. Democrats set policies in place to encourage it because they think they’ll reap electoral rewards later. And establishment Republicans, even the ones who don’t overtly agree, still refuse to fight back in any meaningful way because their big business donors love cheap labor. Either way, it’s working Americans of all races who get the shaft.

Air Travel

Have you been to an airport lately? If you’re one of the lucky ones, you didn’t spend hours or even days longer there than you originally planned. Sure, useless mask mandates are gone for passengers, making flying just a bit more tolerable, but vaccine mandates and mask mandates for unvaccinated workers - especially air traffic controllers - have wreaked havoc on air travel, causing massive delays and cancellations and making things more dangerous than they have to be. If you don’t think it’s being done on purpose, just watch this Tucker Carlson segment.

Covid Fear

Given recent death counts and the fact that most Americans are more than ready to get back to normal life, there’s only so much of this they can continue to stoke. But they’re trying, using the same playbook they’ve used the past two-plus years. I’ve written on this extensively over the past two years so I won’t belabor it here. Suffice it to say that it’s a means to an end for them, a way to establish and maintain control that can be used for their purposes going forward. That’s why we have to continue the fight, even during times when the insanity seems to be on the wane. 

Anarcho-Tyranny

What is the meaning of all this? What does the kind of society these ghouls want to create look like? For a quick answer, take a look at what’s happened to so many January 6th protestors for simply walking into the Capitol building versus what’s happened to rioters who burned and looted buildings and took over the streets of major cities for months in 2020. Then, look up the definition of anarcho-tyranny. This is their plan, and has been all along. Violent criminals run wild while ordinary Americans get preyed upon by their government and its badged and badgeless minions.

So far, it’s all going according to plan. It’s up to us to stop it.
