The Biden administration comes up with a sneaky new amnesty plan

The Biden administration has come up with a stealthy new tack for granting amnesty to the two million illegal aliens who've crossed into the states in the last two years: By "forgetting" to file the paperwork on time.

According to Fox News:

Tens of thousands of illegal immigrants had their cases thrown out by immigration judges after documents were not filed in time by Department of Homeland Security officials, according to newly released data.

Data obtained and analyzed by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University, found that 63,586 cases were dismissed in FY 2022 as of the end of September because officials, mainly Border Patrol agents, are not filing the Notice to Appear (NTA) in time.

That may not seem like much of anything on the surface, but for illegal immigrants, that's winning the jackpot.

According to Fox, it begins like this:

TRAC, which obtained the numbers via a Freedom of Information Act (FOIA) request, found that numbers spiked from less than 1,000 incidents of no NTAs being filed in February and March 2021 to more than 5,000 a month in late 2021 and 2022. In April 2022, more than 7,000 cases were thrown out.

Now it's 63,586 cases, as the earlier part of the Fox report, cited above, indicated. What a coincidence. Suddenly, the paperwork is not being filed on time. Suddenly, someone who used to do his job right is ... not doing his job right. Suddenly, someone ... forgot. Don't tell us that's not some kind of amnesty-through-incompetence passive-aggressive policy. It's just amazing how Biden's policy always seems to go one way -- benefitting the illegally present foreigner.

Fox continues into how it gets good for the illegal aliens:

The research center says that the amount of cases being thrown out is not only wasteful of the court’s time, but also problematic for the immigrants involved — who may turn up for a court date only to have the case dismissed, and be left in limbo as to their status and what to do next. 

With no court case against them, they are free to move about the country, and more specifically, file for green cards and U.S. citizenship. The absence of any court case to resolve regarding their immigration status leaves them free to apply, and with Joe Biden's yes-men at the ready, free to get those green cards.

The precedent for that was from an incident earlier this year, similar, but not the same, to this curious approach to what is effectively amnesty.

Back in June, the Washington Examiner reported that federal prosecutors were simply dropping a million cases for no reason whatsoever:

Federal prosecutors are quietly dismissing stacks of cases against illegal immigrants [sic] under a Biden administration mandate that could be on pace to effectively pardon 1 million people by 2024, according to leaked information reviewed by the Washington Examiner.

Attorneys for U.S. Immigration and Customs Enforcement have begun to throw out tens of thousands of the 2 million backlogged cases in immigration court following a political appointee's order not to go after illegal border crossers from before the November 2020 election.

"This is a de facto amnesty," said an ICE federal prosecutor who spoke with the Washington Examiner on the condition of anonymity.

The impact? According to the Examiner:

The tens of thousands of noncitizens who have been cleared from the immigration court dockets over the past eight weeks may now apply to become permanent legal residents, the prerequisite to becoming a U.S. citizen. An illegal border crosser is barred from applying for legal permanent residency as long as his or her case is pending in court. With no case pending, they may apply. Once approved, they may apply for adjustment of status to citizenship after five years.

"All those removable aliens will be able to live and work in the United States indefinitely — which, in this context, means forever or at least until they themselves decide to leave. That is the definition of an amnesty," Arthur wrote.

The illegals whose fed minders are "forgetting" to file the paperwork may get a new date, as the Fox report notes, but the report suggested that that was discretionary. More likely, they won't get a new date, and the dockets will clear for them to remain in the country without any lawmen looking for them as they vote, collect welfare, clog emergency rooms, and take American jobs, while being free to apply for green cards and U.S. citizenship well ahead of all the legal applicants for entry to the U.S. who are doing it the right way.

 The news of this "forgetfulness" on the part of the Biden administration officials is bound to filter back to the human smuggling rackets, who use this kind of news to recruit migrant caravans on social media and among would-be illegal migrants themselves, who follow this kind of news from the U.S. closely.

Already, the numbers of illegal aliens rolling in is hitting record highs. 

Here are the human waves in Colombia who are heading to the states, just from Venezuela alone, their human traffickers at the sidelines, herding them like sheep. Many of the migrants in these rivers of humanity are Venezuelans who had already fled to other Latin American countries in years past and are now responding to the U.S.'s open door:

The tweet says it's 90,000 migrants a month making that passage, and Colombia is calling it a grave crisis. Venezuela is just one country. Migrants are rolling in from more than 100 countries, according to Border Patrol data.

Now they're "forgetting" to file paperwork, and migrants are finding it easier than ever to gain free admission to the U.S. whether the locals want it or not. Other than inflation, is there any greater Biden failure?

Joe Biden Welcomes Foreign Population at Southern Border Greater than 15 States

President Joe Biden’s Department of Homeland Security (DHS) welcomed a foreign population at the United States-Mexico border in fiscal year 2022 that exceeds the populations of 15 states.

As Breitbart News reported, Biden’s DHS has overseen the largest inflow of illegal immigration in a single fiscal year with more than 2.2 million border crossers and illegal aliens having arrived at the southern border from October 1, 2021, to September 20, 2022.

“We have simply never seen these numbers before in our history, and the Biden open-borders policies are the reason,” former Customs and Border Protection (CBP) Chief Mark Morgan, a visiting fellow at the Heritage Foundation, said in a statement.

“As bad as it has gotten, things will only get worse, and I fear what major catastrophe could come next,” Morgan continued.

The record-breaking level of illegal immigration indicates that in fiscal year 2022, Biden’s DHS welcomed a foreign population to the U.S. that exceeds the resident populations of Wyoming, Vermont, Alaska, North Dakota, South Dakota, Delaware, Montana, Rhode Island, Maine, New Hampshire, Hawaii, West Virginia, Idaho, Nebraska, and New Mexico.

“The time for excuses is over—the next Congress needs to take actual steps to hold this administration accountable for the chaos and carnage they have unleashed on our southwest border,” former Acting Immigration and Customs Enforcement (ICE) Director Thomas Homan, also a visiting fellow at the Heritage Foundation, said:

This is a shameful episode in our history, and the ones who are suffering are not the elites in their gated and secured Beltway communities. It’s the Border Patrol agents being overwhelmed on a daily basis. It’s the families who have been ripped apart losing a loved one to fentanyl or other drugs. And it’s the migrants themselves, who are worthless to the cartels once they’ve been paid. The next Congress better do something about it. [Emphasis added]

As quickly as border crossers and illegal aliens have been arriving at the southern border, Biden’s DHS has been just as quickly releasing most of them into American communities.

From February 2021 to August 2022, for example, the Biden administration released about 1.35 million border crossers and illegal aliens into the U.S. interior — a foreign population roughly three times the size of Miami, Florida.

A set of promises made by House Republican leadership vows to continue building border wall along the southern border while ending the administration’s massive Catch and Release network and mandating E-Verify nationwide to eliminate the job magnet for future border crossers.

Border Crisis: The Biden Administration's Late-Night Friday News Dump

 Friday news dumps are a staple of political strategy, wherein the release of damaging or unflattering information is times to coincide with most people tuning out the news as they enter their weekends.  It's a tried and true practice, employed by partisans of all stripes.  Late last Friday evening, when many Americans were several drinks deep or already in bed, the Biden administration published the September statistics from the Southern border.  They were terrible.  Sarah wrote up the basics yesterday, but I wanted to make sure that this story got top billing on a Monday.  Democrats and many of their media allies only acknowledge the border crisis in the context of smearing border agents or railing against 'cruel' actions by Republican governors.  They don't want to talk about what's actually happening down there, which is a direct result of this president's reckless and failing policies.  A total, ongoing, dysfunctional, unmitigated disaster:

As Julio points out, the sky-high encounters statistic -- more than 227,000 for September alone, and over 2.3 million for the year -- does not include tens of thousands of monthly known got-aways.  Since Biden took office, US officials have detected and logged approximately one million known got-aways.  Fox's Bill Melugin adds more data and context into the mix:

These numbers dropped just before 11pm on Friday, with the president (once again) at the beach for the weekend.  More from Melugin:

Controlling the border is a national sovereignty and law and order issue.  It also has public safety and national security components.  If US agents apprehended 20 suspects from the FBI's terrorism watch list at the border last month, how many dangerous people were among the tens of thousands who were not arrested?  As I mentioned above, roughly one million known got-aways have been observed and catalogued since the start of the Biden administration.  It stands to reason that illegal immigrants who know they'd be prioritized for detention or deportation would undertake greater efforts to avoid capture, so it's a safe assumption that people who represent public safety and national security threats are overrepresented in the 'got-away' categories.  How is this remotely acceptable to anyone?  There's also this awful statistic to consider:

This border crisis is historically deadly.  It is not at all compassionate to incentivize this mass lawlessness, which is literally what the Biden administration has done and continues to do.  It has resulted in death, systemic sexual assault, and chaos -- all of which is massively enriching Mexican drug cartels, who are running the largest-scale human trafficking on earth, effectively aided and abetted by the United States government.  It's scandalous.  And the people in charge won't even acknowledge the reality of the crisis, focused instead on clumsy political optics.  I'll leave you with this -- on and on it goes: (Click title to view tweets)

Illegal Migrant Crossings Continue to Soar Despite What Biden Wants You to Think

Illegal migrants encounters have hit a record new high as President Joe Biden insists the amount of encounters have slowed. 

Customs and Border Protection (CBP) have reported over an estimated 227,000 illegal migrant encounters along the southern border at the hands of Biden’s lax border policies. 

“CBP and DHS will continue to work with our partners in the region to address the root causes of migration, expand legal pathways, facilitate removals, and take thousands of smugglers off the streets… no matter what smugglers say, those who do not have a legal basis to remain in the country will be removed and people should not make the dangerous journey,” CBP Commissioner Chris Magnus said.

As of the fiscal year for 2022, the CBP reported about 2.3 million illegal encounters, up 41 percent, making history from the year before. It was also revealed that 19 percent of those encounters had been stopped at the southern border at least one other time. 

Additionally, the CBP said that migrants are from authoritarian government run country ore such as Venezuelan, Cuban and Nicaraguan increased by 15 percent over the past year, or 245% higher in September 2022 compared to September 2021.

According to an NPR poll from earlier this year, majority of voters find the border crisis to be an invasion of the U.S. 

The poll found that 54 percent of Americans, including 40 percent of Democrats, believe it is "completely true" that the border crisis is an "invasion.”
