Local authorities ignore ICE, release illegal migrant charged with rape and kidnapping back into community

A Honduran national who illegally entered the United States was apprehended by authorities for the third time in October, U.S. Immigration and Customs Enforcement recently reported.

It is unclear when or where the unnamed individual entered the country, according to ICE. However, law enforcement noted that he was not inspected or admitted into the U.S. by an immigration official.

U.S. Border Patrol apprehended the man in June 2021 near Roma, Texas. He was released and issued a notice to appear before an immigration judge.

On July 20, 2023, authorities again detained the individual. Herndon Police Department in Herndon, Virginia, charged the illegal immigrant with felony rape by force, threat, or intimidation. He was also charged with abduction by force and assault on a family member.

Following the arrest, he was held at the Fairfax County Adult Detention Center in Fairfax, Virginia.

Enforcement and Removal Operations Washington, D.C., issued an immigration detainer for the individual on the same day as his arrest.

Less than one month later, the accused rapist was released by the detention center, and officials failed to notify ERO.

Fox News national correspondent Bill Melugin wrote on X, “An illegal immigrant from Honduras who was released into the US after being apprehended by Border Patrol in TX in June 2021 is now charged with felony rape & abduction by force in Virginia. He was arrested by local police there, but the Fairfax County jail didn’t honor ICE’s detainer request - and released him back into the community without notifying ICE.”

Last month, ERO deportation officers arrested the illegal immigrant and served him with a notice to appear before an immigration judge.

ICE reported that the immigrant will remain in custody while awaiting the outcome of the Department of Justice’s removal proceedings.

ERO Washington, D.C., Field Office Director Russell Hott stated, “This undocumented Honduran national has proven to be a detriment to our community and a threat to Virginia residents.”

“ERO Washington remains committed to apprehending criminals who are released back into the local population when a detainer is not honored. We will not allow such noncitizen offenders to roam free and victimize innocent people,” Hott added.

On Tuesday, U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations San Antonio deported another Honduran national who was accused of aggravated sexual assault.

Wilian Emilson Castro Bustillo, 34, illegally entered the U.S. in June near Eagle Pass, Texas. He was apprehended the same day by Border Patrol agents who issued him a notice to appear. Castro was removed due to “an active foreign arrest warrant in Honduras.”

ERO San Antonio Interim Field Office Director Garrett Ripa stated, “We will remain committed to our ERO mission of removing criminals from the U.S. in efforts to keep our communities safer.”
